Workers Compensation Claim: Oil Field Employee Death
An oil field worker was killed while driving to a remote work site for this workers compensation claim. The insurance company denied the claim, arguing it was not work related since the employee was merely driving to work, which is not covered under Kansas workers’ compensation law. We argued that when travel is an inherent part of the job, driving to a remote location other than the principle place of business was not the same as driving to work. The case was litigated to the Kansas Court of Appeals, and the lawyers from Accident Recover Team prevailed, securing death benefits for the family dependents under Kansas law.
